What Is a Data Preservation Request?
A data preservation request asks AskBiz to retain specific user data that would otherwise be deleted under our normal retention schedule, pending the service of full legal process.
Preservation does not mean disclosure. We preserve the data in a secure, segregated state while the requesting authority obtains the necessary legal orders for actual disclosure.
Preservation Process
Upon receipt of a valid preservation request:
1. We acknowledge receipt within 2 business days
2. We create a point-in-time snapshot of the specified account data
3. We retain that snapshot for 90 days pending service of a formal legal order
4. If no formal order is received within 90 days, the preserved data is released back to normal retention schedule (one renewal of 90 days is possible upon request)
5. If a valid legal order is received within the preservation period, we process it per our Law Enforcement Requests policy
User notification: We do not notify the account holder of a preservation request unless legally required to do so, as notification could prejudice an investigation.
Requirements for Preservation Requests
Preservation requests must come from law enforcement or government agencies with jurisdiction over the matter, and must specify:
- The account to be preserved (email address or account ID)
- The data categories to be preserved
- The investigation or legal proceeding the preservation relates to
- The authority's contact details
- The legal basis for the preservation request
